Overview
These Terms of Use govern the TBC website at www.thebrandcraft.com and any related applications, software, programs, platforms, tools, or digital channels (collectively referred to as the "Site"). Within this Agreement ("Terms of Use"), "you" refers to the individual accessing the Site, and, if applicable, the corporation or other legal entity on whose behalf the Site is accessed. "TBC" refers to The Brand Craft and its affiliated companies. Your use of the Site is subject to these Terms of Use and the TBC Privacy Policy.

By accessing or using the Site, you confirm that you have read, understand, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you should not use the Site.

Ownership
Owned by Blue Dome Investments, TBC holds all rights, titles, and interests in and to the Site, including all intellectual property rights. This encompasses copyrights, patents, trademarks, trade secrets, know-how, and all other proprietary rights in the Site and its contents ("Content"). No rights, titles, or interests in the Site or its Content are transferred to you under this Agreement. The Content on the Site is protected under Oman copyright law. TBC or third-party licensors own the copyrights, and the Content is protected as a collective work. The trademarks, service marks, and logos ("Trademarks") on the Site are owned by TBC or respective owners and may not be used without written permission.

License
Subject to these Terms, TBC grants you a limited, revocable, non-transferable license to use the Site for legitimate purposes only. You may not use the Site for unauthorized purposes, copy, reproduce, publish, display, distribute, transmit, transfer, modify, or create derivative works without written permission from TBC.

Additional Restrictions
You may not:

Delete or modify any copyright or trademark notices.
Publish, perform, or display any part of the Site.
Use the Site unlawfully or in a way that could damage or impair TBC's servers or networks.
Sell, resell, or commercially exploit the Site.
Use automated means or manual processes to monitor, copy, interfere with, or disrupt the Site.

Authority
You represent and warrant that you are at least 18 years old and possess the legal capacity to enter into this Agreement.

 

Service Descriptions
TBC strives for accuracy but does not guarantee that service descriptions or other Site Content are accurate, complete, reliable, current, or error-free.

Electronic Communications
By using the Site or sending electronic communications to TBC, you consent to receive electronic communications from TBC, including emails and notices posted on the Site or its digital channels.

Change or Deny Access
TBC reserves the right to change, limit access to, or shut down the Site at any time without prior notice.

Disclaimer of Warranties
The Site and its Content are provided "as is" and "as available." TBC disclaims all representations, warranties, and conditions, express or implied, including any warranties of merchantability or fitness for a particular purpose. TBC does not guarantee uninterrupted or error-free operation of the Site or that it will be free from viruses or harmful components.

 

Limitation of Liability
Your use of the Site is at your sole risk. TBC is not liable for any damages arising from your use of the Site, including special, exemplary, punitive, indirect, incidental, or consequential damages. TBC's total liability in connection with this Agreement will not exceed OMR 10 (ten Omani Rials).

Indemnification
You agree to defend, indemnify, and hold harmless TBC and its affiliates from all claims, including legal fees, arising from your use of the Site.

Links
The Site may contain links to other websites. These links are provided for convenience and do not constitute an endorsement by TBC. Your use of linked sites is at your own risk.

Relationship
The relationship between you and TBC is that of independent contractors. Nothing in this Agreement creates a partnership, joint venture, fiduciary, employment, or agency relationship.

Attorney’s Fees
If TBC prevails in any action to enforce this Agreement, it will be entitled to recover reasonable attorney’s fees and litigation costs from you.

Injunctive Relief
You acknowledge that any violation of this Agreement will cause irreparable harm to TBC, and TBC is entitled to seek injunctive relief.

​

Governing Law; Jurisdiction
This Agreement is governed by the laws of the Sultanate of Oman. You consent to the exclusive jurisdiction of the courts in Muscat, Oman.

​

Termination
TBC may terminate this Agreement at any time for any reason. Upon termination, all rights granted to you will cease, and you must stop using the Site. Certain provisions, such as disclaimers of warranties, limitations of liability, and indemnification, will survive termination.

Assignment
You may not assign this Agreement. TBC may freely assign this Agreement. This Agreement binds and benefits the parties and their respective successors and assigns.

Modification
TBC may update this Agreement at any time. Updates are effective immediately upon notice, which may be provided by posting a revised version on the Site. Your continued use of the Site signifies your consent to be bound by the updated terms.

 

Severability
If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect.

 

Waiver
TBC's failure to enforce any provision or exercise any right does not constitute a waiver. All waivers must be in writing.

 

Entire Agreement
This Agreement, together with the TBC Privacy Policy, constitutes the entire agreement between you and TBC regarding your use of the Site.
